What’s new in Version 2.3
Version 2.3 (effective April 20, 2026) introduces a Consumer Protection & Auto-Renewal section (§14 below), a Hybrid Limitation of Liability framework (§15 below) including an AI-Error Carve-Out with Ombudsperson review, and a new Insurance Coverage section (§16 below). A self-serve Arbitration Opt-Out form is referenced in §19.

These Terms constitute a legally binding agreement between you and Divorsay, Inc. (“Divorsay,” “we,” “our”), a Delaware corporation. By checking the “I agree” checkbox during registration, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

(“Divorsay,” “we,” “our”) is a technology company that provides AI-powered organizational tools, financial calculators, document management, and general legal information resources to help individuals prepare for the divorce process. DIVORSAY IS NOT A LAW FIRM. DIVORSAY DOES NOT PROVIDE LEGAL ADVICE, LEGAL REPRESENTATION, OR ATTORNEY SERVICES. No attorney-client relationship is created by your use of the platform, and no attorney-client privilege attaches to any information you provide or any output you receive.

DIVORSAY provides general statements about what the law provides, explains procedures and deadlines, describes options available under the law, provides court-approved forms and templates, explains legal terminology in plain language, performs calculations using statutory formulas and user inputs, and organizes user-supplied information into structured formats. DIVORSAY does not apply law to your specific facts, make specific recommendations about what you should do, analyze your specific situation to recommend a course of action, predict outcomes for your specific case, or recommend which legal options to pursue.

User Content, including sensitive personal information and case documents, may be transmitted to and processed by third-party AI systems (Anthropic Claude) solely to provide the services described herein. DIVORSAY does not use your data for AI model training.
Each DIVORSAY feature operates within specific boundaries designed to ensure compliance with applicable law.
Auntia™ (Legal Information)
Auntia is an informational tool powered by artificial intelligence. It is not an attorney. It does not provide legal advice, legal representation, or create an attorney-client relationship. Auntia provides general information about family law in your state to help you better understand the divorce process. The information provided should not be relied upon as a substitute for consultation with a qualified, licensed attorney in your jurisdiction. Laws change frequently, and the information provided may not reflect the most current legal developments.
ClearSplit™ Calculator
ClearSplit is a financial calculator that performs mathematical computations based on the information you provide. It does not constitute legal advice, financial advice, tax advice, or a binding property settlement proposal. All calculations are estimates based on general formulas and the data you enter. Actual division of assets and debts in your divorce will be determined by negotiation between the parties, mediation, or court order, and may differ significantly from ClearSplit estimates. Results should be reviewed by a qualified attorney and/or financial advisor before making any decisions. DIVORSAY is not responsible for any decisions made based on ClearSplit calculations.
Case Framing
Case Framing is an organizational tool that structures the facts you provide into topic-based summaries for your personal use and for sharing with your attorney. It does not evaluate the legal significance of your facts, assess the strength of any legal position, or provide legal analysis. The narratives generated are summaries of the information you entered, organized for clarity — they are not legal documents and should not be treated as legal arguments. An attorney should review all materials before any legal use.
Communication Shield
Communication Shield is a writing assistance tool that helps you express your thoughts in a professional, neutral tone. It does not provide legal advice about what to say or not say, does not guarantee that rewritten messages will be favorable in legal proceedings, and does not create any legal protection. The tool adjusts tone and language — it does not evaluate the legal implications of your communications. You are solely responsible for the content and consequences of any message you send.
Evidence Vault
Evidence Vault is a secure document storage and organization tool. The AI-assisted categorization and analysis features are designed to help you organize your documents — they do not constitute legal analysis of your evidence. Items flagged for review are identified based on data patterns and should be discussed with your attorney, who can evaluate their legal significance. DIVORSAY does not make determinations about the admissibility, relevance, or legal weight of any document.
Custody Tracker
Custody Tracker is a personal record-keeping tool for logging parenting time, exchanges, and co-parenting interactions. The data summaries and AI-generated reports are organized presentations of the information you entered — they are not legal documents. These records have not been verified, certified, or reviewed by any legal professional. Before using any custody tracking data in legal proceedings, have your attorney review the records and advise on their appropriateness and format for court submission.
Attorney Handoff
The Attorney Handoff package compiles the information and documents you have organized on the DIVORSAY platform into a single exportable format for delivery to your attorney. This package contains user-organized materials, not legally reviewed or certified documents. Your attorney will conduct their own review and analysis of all materials. DIVORSAY makes no representations about the completeness, accuracy, or legal sufficiency of the handoff package.
Freedom Compass & Readiness Quiz
The Freedom Compass is an organizational framework designed to help you prepare for the divorce process in stages. It is a preparation and wellness journey, not a legal process guide. The Readiness Quiz generates suggested preparation steps based on the general information you provide. These suggestions indicate which DIVORSAY tools may be relevant to your situation — they are not a legal action plan and do not constitute advice about what legal steps to take.
Phoenix Plan
The Phoenix Plan provides general informational guidance about common post-divorce tasks including financial rebuilding, credit recovery, name changes, beneficiary updates, and co-parenting structures. This guidance is general in nature and may not apply to your specific circumstances. Some post-divorce tasks may have legal, tax, or financial implications that require professional advice. Consult appropriate professionals before taking action on any post-divorce task.

The Free tier provides access to ClearSplit financial analysis, the Readiness Quiz, Freedom Compass, and limited AI interactions (3 per day). Free tier accounts retain all data indefinitely. We will never delete your data because you chose not to upgrade.

The Platform, including its design, code, AI models, and content, is owned by Divorsay, Inc. and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of all content you upload to the Platform (documents, photos, communications). By uploading content, you grant us a limited license to process, store, analyze, and display your content solely for providing the service to you.
Documents generated by the Platform (worksheets, case narratives, attorney briefings) are provided for your personal use in connection with your divorce preparation.
THE PLATFORM AND ALL INFORMATION, TOOLS, CALCULATIONS, AND OUTPUTS PROVIDED THROUGH THE PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DIVORSAY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, AND NON-INFRINGEMENT. Subscription and auto-renewal. If you enroll in a subscription plan, your subscription will automatically renew at the end of each billing period unless you cancel. Your payment method will be charged automatically on each renewal date. You may cancel at any time through your Account settings or by contacting Divorsay.
Free-trial conversion notice. If you enroll in a free trial, your trial period will end on the date specified at enrollment. At the end of the trial, your Account will convert to a paid subscription unless you cancel before the trial ends. You will receive an email notice at least seven (7) days before your trial ends.
30-day money-back guarantee. Divorsay offers a 30-day money-back guarantee for new paid subscriptions. To request a refund, contact billing@divorsay.com within 30 days of your initial charge.
Cancellation.To cancel, log into your Account, navigate to Account Settings, select “Subscription,” and click “Cancel Subscription.” Cancellation channels are available with parity to the enrollment channel.
Base Liability Cap.To the maximum extent permitted by law, Divorsay’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (A) ten thousand U.S. dollars ($10,000) or (B) the total amount of fees paid by you to Divorsay during the twelve (12) months immediately preceding the event giving rise to the claim.
Plain-English summary: for most claims, the most we will pay you is whichever is bigger: $10,000 or the fees you actually paid us in the past year. Some serious claims (like fraud or our gross negligence) are not capped. AI errors have their own special path described next.
AI-Error Carve-Out. For claims arising specifically from demonstrable errors in AI-generated output that caused reliance harm, you may elect to pursue one of two pathways (not both): (a) the Base Liability Cap above, or (b) the AI-Error Carve-Out described here.
Reciprocal indemnification.In cases of materially and egregiously incorrect, fabricated, or otherwise unreasonably unreliable AI output (“Gross AI-Output Errors”), Divorsay will indemnify users for documented harm, subject to the caps above and to the insurance coverage described in Section 16.
Carve-outs.The caps above do not apply to damages arising from Divorsay’s fraud, gross negligence, willful misconduct, or intellectual property infringement, and do not limit your non-waivable statutory rights (including but not limited to the California Consumer Privacy Act private right of action, the Illinois Biometric Information Privacy Act, or comparable state laws).
IN NO EVENT SHALL DIVORSAY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EXCEPT WHERE PROHIBITED BY THE CARVE-OUTS ABOVE.
Divorsay maintains the following insurance coverages to support the risk-allocation framework in Section 15:
Current carriers, policy limits, and effective dates are published on our Insurance Disclosure Page, which is updated within five (5) business days of any material change.
Material lapse notice. If any of the coverages described above lapses without replacement for a period exceeding thirty (30) days, Divorsay will update the Insurance Disclosure Page within five (5) business days and notify active paying users by email and in-app banner.
Claims administration. Where a claim triggers coverage, Divorsay may share limited personal information with insurers, brokers, coverage counsel, and forensic vendors as necessary to administer the claim. See the Privacy Policy for details.
Insurance proceeds may satisfy Divorsay’s indemnification obligations under Section 15. Users are not third-party beneficiaries of these policies and are not named insureds, except where a carrier satisfies Divorsay’s obligations to a user under these Terms.
By using the DIVORSAY platform, you acknowledge and agree that:
DIVORSAY shall not be liable for any loss, damage, or adverse outcome resulting from your reliance on Platform outputs without independent professional legal review.
You agree to indemnify, defend, and hold harmless Divorsay, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Platform; (b) your reliance on information or outputs provided through the Platform; (c) your violation of these Terms of Service; (d) your violation of any applicable law; (e) any misrepresentation by you regarding the information you provide to the Platform; or (f) any claim by a third party arising out of or relating to your use of the Platform or the information you obtained through it.
However, you will not indemnify Divorsay for claims arising from Divorsay’s own breach of these Terms, negligence, gross negligence, willful misconduct, violation of law, or fraud.

This section contains a binding arbitration agreement and class action waiver that affect your legal rights.
BINDING ARBITRATION.Any dispute, claim, or controversy arising out of or relating to your use of the DIVORSAY platform, these Terms of Service, or any information or output provided through the platform, including but not limited to claims of unauthorized practice of law, negligence, breach of contract, deceptive trade practices, unjust enrichment, or any other legal theory, shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16.
CLASS ACTION WAIVER. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against DIVORSAY.
OPT-OUT. You may opt out of this arbitration provision within thirty (30) days of your first acceptance of these Terms. Opt out via the self-serve form at divorsay.com/legal/arbitration-opt-out, or by sending a written opt-out notice to legal@divorsay.comwith subject “Arbitration Opt-Out.” Either method returns a dated email confirmation — retain it for your records.
COST ALLOCATION.Divorsay will pay all arbitration filing fees and arbitrator costs exceeding the amount you would pay to file a case in a court of general jurisdiction. If you prevail in arbitration, Divorsay will reimburse your reasonable attorneys’ fees.
EXCEPTION. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights. Claims within small claims court jurisdiction may also be brought in small claims court.
The DIVORSAY Attorney Portal is a technology tool that provides attorneys with access to materials their clients have organized using the DIVORSAY consumer platform. DIVORSAY does not participate in the attorney-client relationship between you and your client.
By accessing the Attorney Portal, you acknowledge that:
Data Processing. With respect to any client data you access through the Attorney Portal: (a) DIVORSAY processes client data solely to provide the Attorney Portal service and does not access, review, or analyze client data for any other purpose; (b) DIVORSAY does not use client data to train AI models; (c) DIVORSAY will process client data in accordance with its Privacy Policy and applicable data protection laws; (d) you are responsible for obtaining any necessary consents from your clients for the sharing of their data through the platform.
Divorsay provides NO legal advice regarding your ethical obligations. You should consult your jurisdiction’s ethics opinions regarding AI use in legal practice.
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on the Platform at least 30 days before the changes take effect.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. If you are a resident of a jurisdiction with more favorable consumer-protection laws, those laws may apply in addition to Delaware law.
Registered Agent for Service of Process. Divorsay, Inc. is a Delaware corporation. Service of process in any action arising out of or relating to these Terms may be made upon Divorsay, Inc. at its Delaware registered office: 8 The Green #26142, Dover, DE 19901.
If any provision of these Terms is found by a court to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, that provision shall be severed from these Terms. The remaining provisions shall remain in full force and effect.
