1. Scope of this notice
This notice explains how DIVORSAY (operated by Divorsay, Inc., a Delaware corporation) uses artificial intelligence systems in its consumer platform and attorney portal. It is intended to satisfy the transparency obligations in the Colorado Artificial Intelligence Act (Senate Bill 24-205, codified at C.R.S. § 6-1-1701 et seq., effective June 30, 2026) and equivalent obligations that may apply in other jurisdictions.
2. Which features use AI?
The following DIVORSAY features use artificial intelligence models to process your inputs and generate outputs:
| Feature | AI role | Primary AI provider |
|---|---|---|
| Auntia™ AI | General legal-information Q&A | Anthropic Claude |
| Case Framing | Preliminary narrative outline generation | Anthropic Claude |
| Settlement Simulator | Illustrative reference scenarios for asset division | Anthropic Claude |
| Draft Studio (Lawyer Mode) | Preliminary draft generation for attorney review | Anthropic Claude |
| Communication Shield | Tone and clarity suggestions for messages | Anthropic Claude |
| Evidence Analysis | Document OCR and organizational tagging | Google Gemini (OCR), Anthropic Claude (tagging) |
| Bill Analyzer | Attorney invoice line-item extraction | Anthropic Claude, Google Gemini (OCR) |

The features listed above are high-impact automated decision systemsfor purposes of Colorado SB 24-205 when their outputs are used to inform decisions in a divorce proceeding. Consumer users interact with these features only after (a) accepting DIVORSAY’s Terms of Service, (b) providing feature-specific consent at first use, and (c) receiving prominent disclaimers that outputs are not legal advice and require attorney review.
3. What data is processed?
Depending on which features you use, DIVORSAY forwards the following data to the AI providers identified above:
- Text you enter into any AI feature (messages, case facts, notes)
- Financial inputs (asset values, liability balances, support figures) for ClearSplit™ and Settlement Simulator
- Documents you upload to Evidence Vault or Bill Analyzer
- Conversation history within Auntia™ AI for session context
- Your state of residence (for state-specific legal information only)
DIVORSAY does not sell user data. DIVORSAY has data processing addenda or equivalent commitments with each AI provider restricting use of data to the processing of your request and prohibiting use for provider model training where contractually feasible.
4. Your rights
4.1 Right to human review
For any AI output on DIVORSAY that you believe has meaningfully affected a decision you are making, you may request human review by emailing support@divorsay.com with the subject line Human Review Request. A DIVORSAY team member will review the specific output within five (5) business days and respond in writing.
4.2 Right to correction
If you believe an AI output contains a factual error, a fabricated citation, a calculation mistake, or a biased characterization, use the Report error button on the output, or email support@divorsay.com. Reported issues are logged, reviewed, and — if the error affects the product — remediated in a subsequent update.
4.3 Right to decline
You may decline the consent required for any AI feature without losing access to non-AI features of DIVORSAY. Core organizational tools (document storage, checklists, calendar) function without AI processing.
4.4 Right to data access, deletion, and portability
You may request a copy of your DIVORSAY data, request deletion of your account and associated data, or request export in a portable format. See our Privacy Policy for detailed instructions and response timelines.
4.5 Right to opt out of arbitration
DIVORSAY’s Terms of Service include an arbitration clause and class action waiver. You have a 30-day window from account creation to opt out. See the opt-out email we send within 24 hours of registration, or review Section 17 of the Terms of Service.
5. Bias testing and accuracy
DIVORSAY is committed to identifying and remediating algorithmic bias in its AI features. The bias-audit program includes:
- Matched-pair testing for Settlement Simulator and ClearSplit™ output distributions across demographic variables, conducted at least annually by an independent auditor.
- Continuous monitoring of user-reported errors, with error-rate thresholds that trigger targeted re-audits.
- Public summary of bias-audit findings published on this page following each audit cycle.
Current status: The first independent bias audit is scheduled for completion before June 30, 2026 (the effective date of Colorado SB 24-205). Summary findings will be published here and available to regulators on request.
6. Known limitations of DIVORSAY AI
- AI outputs may contain fabricated or inaccurate citations to cases, statutes, or rules.
- AI outputs may miss recent changes in law or local court practice.
- AI cannot account for judge-specific preferences, opposing counsel dynamics, or negotiation leverage.
- Financial estimates from ClearSplit™ and Settlement Simulator are not predictionsof actual outcomes — judicial discretion and negotiation materially affect results.
- AI is not a substitute for a licensed attorney. Every material output should be reviewed by an attorney before use in court filings, settlement negotiations, or communications with opposing counsel.
7. Complaints and regulatory contacts
If you believe DIVORSAY has failed to meet its obligations under this notice or applicable law:
- Email legal@divorsay.com with the details of your concern. We will acknowledge within three (3) business days.
- Colorado residents may also file a complaint with the Colorado Attorney General’s Consumer Protection Division at coag.gov.
- Residents of other states may file with their state’s consumer protection agency.
8. Updates to this notice
This notice may be updated as DIVORSAY’s AI features evolve, as regulatory obligations change, or as audit findings are published. Material updates will be emailed to registered users at least 14 days before taking effect.
