What happens at a divorce hearing?
Divorce hearings can take several forms depending on the stage of your case and whether issues are contested. Understanding what to expect can help reduce anxiety and improve preparation.
An initial hearing or status conference is often the first court appearance. This is typically brief and procedural. The judge may set deadlines for discovery, order temporary support, establish a timeline for the case, and encourage settlement discussions.
If temporary orders are needed (for custody, support, or use of the family home during the divorce), a temporary orders hearing may be held. Both sides present evidence and arguments, and the judge issues orders that remain in effect until the divorce is finalized.
If the divorce is uncontested, the final hearing is often straightforward. The judge reviews the settlement agreement, asks a few questions to ensure both parties understand and agree to the terms, and issues the final decree. In some jurisdictions, this hearing can take as little as 15 to 30 minutes.
For contested divorces, the trial hearing is more involved. Both sides present evidence, call witnesses, and make legal arguments. The judge then issues decisions on all disputed matters. Contested trials can last from a few hours to several weeks depending on the complexity of the case.
General courtroom etiquette tips include arriving early, dressing professionally, addressing the judge as "Your Honor," speaking only when asked, and remaining calm and respectful.
